TERMS AND CONDITIONS OF SALE

1. Scope

These Terms and Conditions of Sale apply to all purchases made through the Emevu online store available at emevu.com.

By placing an order, the customer confirms that they have read and accepted these Terms and Conditions before completing the purchase.

These Terms apply primarily to consumers purchasing products for personal use.

2. Seller information

3. Products

The essential characteristics, available options, intended use and price of each product are displayed on the relevant product page.

Customers are responsible for reading the product description, specifications and instructions before placing an order.

Product photographs, videos and illustrations are provided for presentation purposes.

Minor differences in colour, texture, packaging or appearance may occur because of:

  • screen settings;

  • photography;

  • manufacturing variations;

  • packaging changes; or

  • product improvements.

These minor differences do not constitute a defect where they do not affect the product’s essential characteristics or intended use.

4. Product availability

Products are offered subject to availability.

Adding a product to the shopping cart does not reserve it.

If a product becomes unavailable after an order has been placed, Emevu will contact the customer and offer one of the following solutions:

  • a full refund;

  • shipment once the product becomes available again; or

  • a suitable replacement, subject to the customer’s agreement.

No replacement will be sent without the customer’s agreement.

5. Prices and currency

Prices are displayed in United Arab Emirates dirhams — AED, unless another currency is displayed during checkout.

The price applicable to an order is the price displayed when the customer confirms the purchase.

Any applicable shipping charges, taxes or other charges known to Emevu will be displayed before the order is confirmed.

Customs duties, import taxes or local administrative charges not collected during checkout may be payable by the customer.

These charges are imposed by local authorities and are not controlled by Emevu.

Emevu may change its prices at any time. Price changes do not affect orders already confirmed.

6. Placing an order

To place an order, the customer must:

  1. select the desired product and quantity;

  2. add the product to the shopping cart;

  3. provide the requested contact, billing and delivery information;

  4. select an available delivery method;

  5. select an available payment method;

  6. review the order details; and

  7. confirm and pay for the order.

Before completing the purchase, the customer is responsible for checking:

  • the selected product;

  • the quantity;

  • the delivery address;

  • the billing details;

  • the email address;

  • the telephone number; and

  • the total price.

The order becomes binding once payment has been accepted and an order confirmation has been sent.

7. Order acceptance

Emevu reserves the right to refuse, suspend or cancel an order in the event of:

  • payment refusal;

  • suspected fraud;

  • unauthorised payment;

  • obviously incorrect pricing;

  • product unavailability;

  • an incomplete or invalid delivery address;

  • unusually large or suspicious order quantities;

  • a breach of these Terms; or

  • a legal or regulatory restriction.

If a paid order is cancelled by Emevu, the amount collected will be refunded to the original payment method.

8. Payment

Available payment methods are displayed during checkout.

Payment must be completed when the order is placed.

Payments are processed through secure third-party payment providers.

Emevu does not directly store complete payment-card numbers or card security codes.

The customer confirms that they are authorised to use the selected payment method.

A bank or payment provider may apply:

  • currency conversion fees;

  • foreign transaction fees;

  • verification procedures; or

  • its own exchange rate.

These charges are outside Emevu’s control.

9. Order confirmation

After payment has been accepted, the customer will normally receive an order confirmation by email.

The customer should check their spam or junk folder if the confirmation is not received.

The order confirmation will normally include:

  • the order number;

  • the products ordered;

  • the amount paid;

  • the delivery address; and

  • the selected delivery method.

Customers should contact contact@emevu.com promptly if any information is incorrect.

10. Order changes and cancellations

Customers wishing to change or cancel an order must contact Emevu as soon as possible.

Emevu will make reasonable efforts to accommodate the request.

However, a change or cancellation cannot be guaranteed once:

  • preparation has started;

  • the order has been transferred to a fulfilment provider; or

  • the order has been shipped.

This section does not affect any mandatory legal right of withdrawal.

11. Delivery area

Emevu currently delivers primarily within the United Arab Emirates.

A destination is accepted only if it is available during checkout.

Emevu may change the available delivery areas at any time.

12. Processing time

Orders are normally prepared within 1–2 business days after payment has been accepted.

Processing may take longer during:

  • public holidays;

  • promotional periods;

  • product launches;

  • unusually high order volumes;

  • stock checks; or

  • exceptional operational disruption.

13. Estimated delivery time

After processing, delivery normally takes approximately 3–7 business days.

These delivery periods are estimates and not guaranteed delivery dates.

Delivery may be delayed because of:

  • carrier disruption;

  • customs procedures;

  • public holidays;

  • weather conditions;

  • incorrect delivery information;

  • failed delivery attempts;

  • remote delivery locations; or

  • circumstances outside Emevu’s reasonable control.

14. Transfer of risk

The risk of loss or accidental damage transfers to the consumer when the consumer, or a person designated by the consumer, physically receives the product.

This does not include a carrier independently selected by the consumer outside the delivery methods offered by Emevu.

15. Inspection after delivery

Customers should inspect the parcel and product promptly after delivery.

Any damaged, defective, incomplete or incorrect product should be reported to:

The customer should provide:

  • the order number;

  • a description of the issue; and

  • clear photographs or video where reasonably necessary.

16. Legal right of withdrawal

Where French or other applicable consumer law grants a right of withdrawal, the consumer may notify Emevu of their decision to withdraw within 14 calendar days after receiving the product.

The customer does not need to provide a reason.

The withdrawal request may be submitted by:

  • emailing contact@emevu.com;

  • using the model withdrawal form available on the Website; or

  • using any electronic withdrawal function provided on the Website.

After notifying Emevu, the customer must return the product within 14 calendar days.

The customer may inspect the product in the same way they would be able to inspect it in a physical store.

The customer may be responsible for any reduction in value caused by handling beyond what is necessary to establish the product’s nature, characteristics and proper functioning.

Unless Emevu agrees otherwise, the direct cost of a change-of-mind return is paid by the customer.

17. Thirty-day commercial return policy

In addition to any mandatory legal right of withdrawal, Emevu offers a commercial return period of up to 30 calendar days after delivery.

For returns requested after the statutory withdrawal period, the product must be:

  • unused;

  • undamaged;

  • complete;

  • in its original condition; and

  • returned with its original packaging, accessories and manuals.

The commercial return policy does not restrict mandatory rights relating to defective, damaged or non-conforming products.

18. Refunds

Refunds are normally issued to the original payment method.

For a valid statutory withdrawal, Emevu will refund the sums due, including the cost of the least expensive standard delivery method initially offered, within the legally required period.

Emevu may withhold the refund until:

  • the returned product has been received; or

  • the customer provides sufficient evidence that the product has been sent back.

For a commercial return made between day 15 and day 30:

  • the product price may be refunded after inspection;

  • the initial shipping cost is not normally refundable; and

  • the return shipping cost is paid by the customer.

This does not apply where the product was defective, damaged, incomplete or incorrect.

Banking and payment-provider processing times may affect when the refund appears in the customer’s account.

19. Damaged, defective or incorrect products

Customers should contact Emevu promptly if a product arrives:

  • damaged;

  • defective;

  • incomplete; or

  • different from what was ordered.

The customer should not discard the product or packaging before receiving instructions.

Where the claim is accepted, Emevu may provide:

  • a replacement;

  • a repair;

  • a partial refund;

  • a full refund; or

  • another solution required by applicable law.

Emevu will cover reasonable return costs for an accepted claim concerning a defective, damaged, incomplete or incorrect product.

20. Legal guarantees

Nothing in these Terms excludes or limits mandatory consumer guarantees.

Where French consumer law applies, consumers benefit from:

  • the legal guarantee of conformity; and

  • the legal guarantee against hidden defects.

The legal guarantee of conformity may allow the consumer to request that a product be repaired or replaced.

Where repair or replacement is impossible, disproportionate or not completed within the legally required period, the consumer may be entitled to:

  • a price reduction; or

  • cancellation of the sale and a refund.

These rights are separate from Emevu’s 30-day commercial return policy.

Consumers may also benefit from mandatory rights under the law of their country of residence.

21. Product use

Products must be used in accordance with:

  • the product description;

  • the supplied instructions;

  • charging instructions;

  • safety warnings; and

  • the product’s intended use.

Emevu is not responsible for damage caused by:

  • misuse;

  • unauthorised modification;

  • improper charging;

  • use with incompatible accessories;

  • exposure to water where the product is not rated as waterproof;

  • failure to follow instructions;

  • normal wear and tear; or

  • accidental damage occurring after delivery.

This section does not limit liability that cannot legally be excluded.

22. Product and health disclaimer

Emevu products are consumer products intended for general personal use.

Unless expressly stated otherwise, they are not medical devices and are not intended to diagnose, treat, cure or prevent:

  • insomnia;

  • tinnitus;

  • anxiety;

  • hearing disorders;

  • sleep disorders; or

  • any other medical condition.

Statements concerning sleep, relaxation or comfort describe the product’s intended use or customer experiences.

Individual results may vary.

Customers experiencing persistent medical symptoms should consult a qualified healthcare professional.

23. Limitation of liability

Emevu is responsible for direct and foreseeable losses caused by a failure to perform its contractual obligations.

To the fullest extent permitted by law, Emevu is not responsible for:

  • indirect or unforeseeable losses;

  • loss of opportunity;

  • loss of data;

  • commercial loss;

  • loss caused by misuse of the product; or

  • losses caused by information incorrectly supplied by the customer.

Nothing in these Terms excludes or limits liability for:

  • fraud;

  • deliberate misconduct;

  • personal injury caused by negligence; or

  • any liability that cannot legally be excluded.

24. Force majeure

Emevu will not be liable for a delay or failure caused by an event outside its reasonable control, including:

  • natural disasters;

  • fire;

  • war;

  • government action;

  • customs restrictions;

  • carrier disruption;

  • cyberattacks;

  • telecommunications failure;

  • strikes;

  • epidemics;

  • pandemics; or

  • major supply-chain disruption.

Emevu will take reasonable steps to limit the impact of such an event.

25. Personal information

Personal information is processed in accordance with the Emevu Privacy Policy and Cookie Policy.

26. Customer service and complaints

Customers may contact Emevu at:

Messages concerning an existing order should include:

  • the customer’s name;

  • the order number;

  • a description of the issue; and

  • the requested resolution.

Emevu will make reasonable efforts to respond within two business days.

27. Consumer mediation

A consumer must first submit a written complaint to Emevu before contacting a consumer mediator.

If the complaint cannot be resolved directly, an eligible consumer may request the free assistance of the consumer mediator appointed by Emevu.

The consumer must generally contact the mediator within one year after submitting the written complaint to Emevu.

28. Governing law

These Terms are governed by French law.

However, this choice of law does not deprive a consumer of mandatory protections granted by the law that would otherwise apply in their country of residence.

Any dispute that cannot be resolved amicably or through mediation may be submitted to a court having jurisdiction under applicable consumer-protection and procedural rules.

29. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

30. Changes to these Terms

Emevu may update these Terms to reflect changes to:

  • the Website;

  • products;

  • delivery methods;

  • business practices; or

  • applicable law.

The Terms applicable to an order are those accepted when the order was placed.
